- meditation,
- yoga,
- music,
- movement,
- dance,
- and related well-being practices.
HealTown acts solely as an intermediary marketplace platform.
HealTown itself does not provide:
- medical treatment,
- psychotherapy,
- psychiatric treatment,
- healthcare services,
- diagnosis,
- emergency services,
- or licensed therapeutic treatment.
Any agreement regarding booked services exists exclusively between:
- the user,
- and the independent provider.
Providers are solely responsible for:
- their services,
- qualifications,
- licenses,
- legal compliance,
- taxes,
- insurance,
- and professional conduct.
3. No Medical or Emergency Services
The platform and its content are intended solely for:
- educational,
- supportive,
- wellness,
- relaxation,
- creative,
- and personal development purposes.
HealTown does not guarantee:
- medical outcomes,
- psychological outcomes,
- therapeutic success,
- or health improvements.
Users experiencing mental health crises or emergencies should immediately contact qualified healthcare professionals or emergency services.
4. Eligibility and Minors
Users may create accounts on the platform.
Minors may only use HealTown with valid consent from a parent or legal guardian.
Providers are responsible for determining whether their services are appropriate for minors.
HealTown reserves the right to request proof of parental consent where necessary.
5. User Accounts
Users are responsible for:
- maintaining secure login credentials,
- keeping account information accurate,
- all activity conducted through their accounts.
HealTown may require:
- email verification,
- identity verification,
- or additional account information.
HealTown reserves the right to suspend, restrict, or terminate accounts violating:
- these Terms,
- applicable laws,
- platform policies,
- or safety standards.
6. Provider Accounts and Verification
Provider accounts may require manual approval before activation.
Providers may be required to submit:
- profile photographs,
- phone numbers,
- identification documents,
- certifications,
- licenses,
- and additional verification information.
Verification status or badges only indicate that certain submitted information has been reviewed to a reasonable extent.
HealTown does not independently guarantee:
- professional competence,
- authenticity,
- legality,
- licensing status,
- or service quality.
Users remain responsible for independently evaluating providers and services.
7. Bookings and Payments
Payments may be processed through third-party payment providers including:
HealTown may facilitate payments between users and providers.
HealTown is not a bank, financial institution, or escrow provider.
8. Platform Fees
8.1 Provider Commission
HealTown deducts a platform commission of 10% from the provider’s listed booking price.
Example:
- Provider session price: €100
- HealTown commission: €10
- Provider payout: €90
Additional payment processor fees may apply.
8.2 User Service Fee
Users pay an additional service fee of 3.5% added to the booking price.
Example:
- Session price: €100
- Service fee: €3.50
- Total user payment: €103.50
HealTown reserves the right to modify fees and pricing structures at any time.
9. Sessions and External Services
Sessions may take place using external third-party services including:
HealTown is not responsible for:
- technical interruptions,
- external platform outages,
- internet failures,
- connection problems,
- or third-party software issues.
Users and providers use external communication tools at their own responsibility.
10. Refund and Cancellation Policy
10.1 Completed Sessions
Completed sessions are non-refundable.
10.2 User Cancellations
If a user cancels more than 72 hours before the scheduled session:
- the user may receive an 80% refund.
If cancellation occurs less than 72 hours before the scheduled session:
- the provider may retain the payment.
10.3 Provider Responsibility
Providers are responsible for:
- refunds,
- cancellation handling,
- rescheduling,
- and disputes regarding their services.
HealTown acts solely as the intermediary platform.
11. Subscriptions and Digital Content
HealTown may offer:
- subscriptions,
- memberships,
- premium features,
- prerecorded meditation content,
- downloadable materials,
- audio packages,
- educational content,
- and digital wellness products.
Subscriptions may generally be cancelled monthly unless otherwise specified.
Digital content may become immediately accessible after purchase.
Where legally permitted, users may waive statutory withdrawal rights for immediately accessible digital content.
12. Messaging and Communication
HealTown may provide internal messaging features.
Users agree not to:
- harass others,
- send illegal content,
- spam,
- impersonate others,
- or misuse communication systems.
HealTown may moderate communications where reasonably necessary for:
- safety,
- fraud prevention,
- abuse prevention,
- and legal compliance.
13. AI Features
HealTown may provide AI-powered:
- support tools,
- recommendations,
- moderation systems,
- or automated assistance.
AI-generated content may be inaccurate, incomplete, or unsuitable for specific situations.
AI systems must not be relied upon for:
- medical advice,
- diagnosis,
- psychotherapy,
- emergencies,
- or crisis intervention.
Users remain responsible for independent judgment and professional consultation.
14. User-Generated Content
Users and providers may upload:
- videos,
- profile images,
- audio,
- certifications,
- reviews,
- comments,
- and written content.
Users retain ownership of their content.
By uploading content, users grant HealTown a non-exclusive license to:
- host,
- display,
- reproduce,
- process,
- and distribute content for platform functionality.
Illegal, abusive, misleading, discriminatory, infringing, or harmful content is prohibited.
HealTown reserves the right to remove content violating:
- these Terms,
- applicable laws,
- or platform standards.
15. Reviews and Ratings
Users may submit reviews and ratings.
Reviews must be:
- truthful,
- respectful,
- lawful,
- and non-defamatory.
HealTown reserves the right to remove or moderate reviews.
16. Intellectual Property
All HealTown branding, software, logos, text, designs, graphics, and platform materials are protected by intellectual property laws.
Unauthorized use is prohibited.
17. Limitation of Liability
HealTown is not liable for:
- provider conduct,
- service quality,
- session outcomes,
- user-generated content,
- external platform failures,
- technical interruptions,
- data loss,
- indirect damages,
- or lost profits.
Mandatory statutory liability remains unaffected.
18. International Use
HealTown may be accessible internationally.
Users and providers are responsible for complying with applicable laws in their own jurisdictions.
19. Data Protection
Information regarding personal data processing is provided in the Datenschutzerklärung (Privacy Policy).
20. Changes to the Terms
HealTown reserves the right to modify these Terms in the future.
Updated versions will become effective upon publication on the platform.
21. Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), where legally permissible.
22. Severability Clause
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected.
